Prohibited Items T&Cs for AFRIDEX

These AFRIDEX terms and conditions (AFRIDEX T&C) apply between each person registered to attend AFRIDEX organised by us (you, your) and DMG Nigeria Events Ltd or the relevant local entity in the DMG Events group of companies (Organiser, us, we, our) and set out the additional terms on which you agree to attend AFRIDEX (the Event).

For the avoidance of doubt, these AFRIDEX T&C are supplementary and in addition to the Visitor Terms. For the purpose of these AFRIDEX T&C, Affiliate means any entity that directly or indirectly controls, is controlled by, or is under common control with the Organiser from time to time.

1. Prohibited Items

1.1 Prohibited Item means any of the following:

  1. cluster munitions as defined in the UN Convention on Cluster Munitions;
  2. electric shock devices;
  3. goods designed for the execution of human beings such as gallows and electric chairs, spiked batons;
  4. restraints, other than ordinary handcuffs, designed specifically for human beings; and
  5. any other items added to this definition by the Organiser via written notice to you.

1.2 You shall not, and shall ensure that your representatives shall not:

  1. bring any Prohibited Item to the Event; or
  2. bring any materials advertising a Prohibited Item to the Event.

1.3 In the event that you are, in our reasonable opinion, in breach of Clause 1.2, we may:

  1. prohibit you from bringing any Prohibited Item into the Event; and
  2. refuse admission to, or eject from, the Event you or any of your attendees.

2. Indemnity

2.1 You indemnify the Organiser and each of its Affiliates against all liabilities, costs, expenses, damages and losses, whatsoever and howsoever arising, whether in contract, tort or otherwise, directly or indirectly, suffered or incurred by the Organiser or any of its Affiliates in connection with any breach of Clause 1.2 of these AFRIDEX T&C.

3. Waiver

3.1 You acknowledge and agree that attending the Event may involve risks, including personal injury, property damage or loss.

3.2 Subject to Clause 3.3 and to the fullest extent permitted by law, you agree to assume all risks associated with attending the Event and hereby release, waive and discharge the Organiser from any and all claims, demands, actions, or liabilities of any kind arising out of or in relation to your attendance at the Event, including attending demonstrations of military equipment and vehicles as part of the Event, including where caused by negligence.

3.3 Nothing in these AFRIDEX T&C shall exclude or limit liability for: (i) death or personal injury caused by negligence, (ii) fraud or fraudulent misrepresentation, or (iii) any other liability which cannot be excluded or limited in accordance with applicable laws.
